Suds Buds Laundry LLC (“we,” “us,” or “our”) provides the Suds Buds website at https://sudsbuds.com, the Suds Buds mobile application, and the Brain Washer trivia game at https://brainwasher.sudsbuds.com (collectively, the “Services”).

These Terms and Conditions (“Terms”) govern your access to and use of the Services. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent that you meet this age requirement. We do not knowingly collect information from or provide Services to children under 13.

2. Description of Services
Suds Buds Laundry LLC operates a brick-and-mortar laundromat located at 540 E 14th St, New York, NY 10009, offering wash, dry, and fold services. We also provide:
– A website and mobile application for placing laundry pickup and delivery orders.
– Brain Washer, a trivia and engagement application accessible at https://brainwasher.sudsbuds.com, which includes daily trivia games, weekly tournaments, and prize fulfillment for eligible users.

3. Account Registration
To access certain features of the Services, including Brain Washer, you must create an account. When you register, you agree to:
– Provide accurate, current, and complete information.
– Maintain and update your information as needed.
– Keep your account credentials secure and confidential.
– Be responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that contain inaccurate information or that we believe have been used in violation of these Terms.

4. SMS Messaging Program (Brain Washer)
By signing up for Brain Washer and providing your phone number along with explicit consent (via the consent checkbox on the signup form), you agree to receive SMS messages from us related to:
– Account verification: One-time verification codes sent during signup or login (typically 1 message per signup or login attempt).
– Prize notifications: Messages alerting you when you have won a Brain Washer trivia prize, with redemption instructions.
– Account-related communications: Notifications about your Brain Washer account or eligibility status.

Message frequency: You will typically receive between 1 and 8 messages per month depending on your activity. Frequency may increase during weekly tournaments or prize cycles.
Message and data rates: Standard message and data rates may apply based on your mobile carrier plan. Suds Buds Laundry LLC is not responsible for any charges your mobile carrier may apply.
Opt-out: You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive a confirmation message and will no longer receive Brain Washer SMS messages. To re-enroll, you may sign up again through the Brain Washer signup page.
Help: For help with the SMS program, reply HELP to any message or contact us at sudsbuds@sudsbuds.com.
Supported carriers: This program is available on most major U.S. mobile carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, Virgin Mobile, and others. Carriers are not liable for delayed or undelivered messages.

5. Brain Washer Game Rules and Prize Eligibility
Brain Washer is offered as a free engagement service to Suds Buds customers. Anyone may sign up and play the daily and tournament games.
Prize eligibility is determined separately based on customer status, order history, and other criteria as published on the Brain Washer service page. Eligibility rules may change at any time at our sole discretion. Prizes, when awarded, are typically issued as discount coupons applicable to future Suds Buds orders. Prize values, types, and frequency are determined at our sole discretion and may change at any time.
We reserve the right to disqualify any player suspected of cheating, automating gameplay, creating multiple accounts, or otherwise violating the spirit of fair play. Decisions on prize eligibility and fulfillment are final.

6. Acceptable Use
You agree not to:
– Use the Services for any unlawful purpose or in violation of any applicable laws or regulations.
– Attempt to gain unauthorized access to any portion of the Services or any related systems or networks.
– Interfere with or disrupt the integrity or performance of the Services.
– Reverse engineer, decompile, or disassemble any portion of the Services.
– Create multiple accounts to manipulate game outcomes or prize eligibility.
– Use bots, scripts, or automated systems to interact with Brain Washer.
– Submit false information when registering or using the Services.

7. Intellectual Property
All content on the Services, including text, graphics, logos, images, audio, video, software, and the Brain Washer name and characters (including Barry Bubblesworth), is the property of Suds Buds Laundry LLC or its licensors and is protected by United States and international copyright and trademark laws. You may not copy, reproduce, distribute, modify, or create derivative works of any content without our express written permission.

8. User-Generated Content
If you submit content to the Services (e.g., photos uploaded for stained-item identification, customer support inquiries, or feedback), you grant Suds Buds Laundry LLC a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display that content for the purpose of operating and improving the Services.
You are solely responsible for the content you submit and represent that you have all rights necessary to submit it.

9. Payment and Refunds
For laundry services placed through our website or mobile app, payment is processed through secure third-party payment processors. By placing an order, you authorize us to charge your selected payment method for the total amount of the order, including applicable taxes and fees.
Refund and cancellation policies are described separately on our website and at our physical location. Brain Washer is a free service; no payment is required to play or to receive prizes.

10. Third-Party Services
The Services may integrate with or link to third-party services (including but not limited to Twilio for SMS, Resend for email, Stripe for payments, and CleanCloud for order management). Your use of these third-party services is subject to their respective terms and privacy policies, which we encourage you to review.
We are not responsible for the content, practices, or services of any third party.

11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SUDS BUDS LAUNDRY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR INTERRUPTION OF SERVICE.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

13. Indemnification
You agree to indemnify, defend, and hold harmless Suds Buds Laundry LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another.

14. Termination
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination (including ownership provisions, warranty disclaimers, and limitations of liability) will survive.

15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.

16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page and may notify you through the Services or by email. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
